These paraphrased questions and associated responses are not part of the contract documents and shall have no bearing whatsoever on the interpretation of the Standard Specifications, the Standard Plans, the Special Provisions, or the Plans. Nor shall they have any bearing whatsoever on the interpretation of other publications referenced therein.

Questions without answers may be posted here to indicate that we have received them before the deadline and we intend to respond.

I'd like to know if a General Contractor with a B license can bid on this opportunity. We have done a lot of concrete projects and walkways for schools and different organizations.  (RFC 49190 submitted 9/8/2022)

No, a California B license contractor cannot be prime for this job based on the Business and Professions Code regulations. Response date: 09/08/2022

Does the County have the survey/staking handled?  (RFC 49216 submitted 9/9/2022) 

Yes. See Specifications Section 5-1.26  Response date: 09/22/2022

Can Exhibits 12-A and 12-B be turned in with our DBE forms, before the 5th calendar day after bid opening?  (RFC 49441 submitted 9/22/2022)

Both parts 1and 2 of Exhibit 12-B must be received by 4pm 5 calendar days after the bid opening. The field in Bid Express has been updated with the correct omission terms. There is no Exhibit 12-A. Response date: 09/22/2022

Will it be the responsibility of the contractor to trim and cut back the trees in the orchard located just north of Annadale Ave?  (RFC 49561 submitted 9/28/2022)

Drawing No. X-1 Specification No. TYPICAL CROSS SECTION
Sheet X1 typical cross sections calls out a "VP" "Vent Pipe" to run from 56+75.00 to 60+30.00 and from 63+75.00 to 65+72.87. Please provide details and type of vent pipe to use.  (RFC 49562 submitted 9/28/2022)

"VP" is in reference to the name of the alignment, and not a vent pipe. The alignment throughout the plan set in plan view is labeled "VP" Line.  Response date: 09/30/2022

Per the Agreement, Article V, the indemnification required of the Contractor may be contrary to law as it does not provide exclusion for the sole negligence, active negligence, nor willful misconduct of the Owner or of the Engineer, and their consultants, and each of their directors, volunteers, officers, and employees pursuant to California Civil Code 2782. Please confirm the required indemnity will be compliant with California Civil Code 2782.
Per the Agreement, Article V, Section C. Professional Liability, Contractor is required to provide a provision for 3-year tail coverage. Please confirm annual evidence of coverage for 3 years would satisfactorily meet this requirement. (RFC 49573 submitted 9/29/2022)

The required indemnity is limited "To the fullest extent permitted by law." An annual certificate of insurance for three years would be sufficient, with the County listed to be notified in an event of lapse of coverage. Response date: 09/30/2022
